The Toledo-Lucas County Port Authority wants to make sure its insurance companies pay claims from an aircraft noise case that could cost the Toledo Express Airport up to $10 million. The authority, which oversees the airport, sued 22 insurance companies Friday in U.S. District Court.
Attorney Steve Smith, who is representing the board, said the lawsuit is designed to make sure the companies will provide coverage on the claims. Some carriers have denied coverage or not responded to questions, he said.
Lawrence Grey, a visiting judge from Athens County, ruled last month in Fulton County Common Pleas Court that the authority is liable to homeowners who have suffered from aircraft noise. A trial to determine damages is scheduled to begin July 13 and could last into August.
David Zoll, an attorney for the homeowners, said he would ask the jury to determine damages. Earlier estimates were as high as $10 million. The authority has $2.9 million in cash reserves.
